The deal, in plain English.

These are the terms for using Anfon. We've written them to be read, not to hide things in the fine print. One honest price, one honest product — and nothing here takes away the rights you have under Australian law.

§Who we are

Anfon is operated by The IT Dept Pty Ltd (ABN 12 665 405 505), based on the NSW Central Coast, Australia. When this page says "we", "us" or "our", that's who we mean.

§The agreement

By creating an account or using Anfon, you agree to these terms, our Privacy Policy, our Acceptable Use Policy, and our Billing & Refunds page. If you're using the service on behalf of an organisation, you're confirming you're allowed to agree on its behalf. If you don't agree, please don't use the service.

§The service

Anfon is Australian email hosting. Your subscription gets you email on your own domain, unlimited aliases, the webmail and mobile apps, and the tools to manage it all. It comes in three plans in AUD — Personal ($5/mo or $50/yr), Family ($10/mo or $100/yr, unlimited household mailboxes) and Business (flat org pricing from $30/mo, never per-seat). Current plans and inclusions are on our pricing page; annual plans work out to two months cheaper.

§Your account

You're responsible for your login and for keeping it secure, and for everyone you add to your account. Keep your contact and billing details accurate so we can reach you and your service keeps working. Each account has one human owner who's ultimately responsible for it.

§Acceptable use

Using Anfon comes with one rule: don't wreck it for everyone else. The details — no spam, no phishing, no illegal content, and so on — are in our Acceptable Use Policy, which forms part of these terms. Breaking it can lead to suspension or termination.

§Domains

If your plan includes a domain, that domain is registered to you — you're the registrant and you own it. We'll manage renewals while you're a customer, and you can transfer it away to another provider whenever you like. Domains are also governed by the relevant registry's terms (for example auDA's policies for .au domains), which apply alongside ours.

§Billing

Prices are in AUD and include GST where applicable. Your subscription auto-renews — monthly or annually, whichever you chose — until you cancel. If we ever change the price, we'll give you advance notice and you can cancel before the new price applies. Full detail is on the Billing & Refunds page.

§Cancellation

You can cancel anytime from your account settings. When you cancel, you keep access until the end of the period you've already paid for, and then the subscription stops renewing. You keep your domain — cancelling the subscription doesn't take it away from you.

§Australian Consumer Law

Nothing in these terms excludes the consumer guarantees under the Australian Consumer Law (ACL). Our services come with guarantees that can't be excluded — for example, that they'll be provided with due care and skill and be fit for their purpose.

Where the law allows us to limit our liability for failing to meet a guarantee, our liability is limited to resupplying the service or refunding the amount you paid. We don't try to exclude anything that can't lawfully be excluded.

§Availability

We aim for the service to be available all the time and we work hard to keep it that way — but no service is up 100% of the time. Occasional maintenance, upgrades and the odd unexpected outage will happen. We'll give notice of planned maintenance where we reasonably can.

§Suspension & termination

We may suspend or terminate your account for a serious breach of these terms or the Acceptable Use Policy, or for non-payment. We'll give you notice and a chance to fix things where it's practical — but for serious abuse (like phishing, malware or illegal content) we may act immediately to protect others. You can also close your account at any time as set out above.

§Liability & indemnity

Subject to the ACL and the consumer guarantees above, and to the extent the law allows: we're not liable for indirect or consequential loss, or for loss caused by things outside our reasonable control. You agree to use the service lawfully and to cover us for loss we suffer because you've used the service in breach of these terms or the law. None of this limits any rights you have that can't be limited by law.

§Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of New South Wales. This doesn't affect any rights you have under the ACL or other consumer protection laws.

§Changes to these terms

We may update these terms from time to time. We'll change the date at the top and tell you about anything significant before it takes effect. If you keep using the service after a change, that's your acceptance of the updated terms.
